  1. By accessing the globalgossip.com site, the noticeboard, My Gossip or any part or element of the Global Gossip website, you agree to be bound by the terms and conditions as outlined below.
  2. These terms and conditions may be changed from time to time without notice and you agree to be bound by the most recent version of these terms and conditions.
  3. All the terms and conditions apply to the Global Gossip website, every aspect thereof, and any part therein whether expressly stated or not, including, but not limited to, globalgossip.com, the noticeboard and my gossip.
  4. Your account and password. When you sign up to become a Member or Partner, you will also be asked to choose a password. You are entirely responsible for maintaining the confidentiality of your password. You agree not to use the account, username, or password of another Member or Partner at any time or to disclose your password to any third party. You agree to notify GlobalGossip.com immediately if you suspect any unauthorized use of your account or access to your password. You are solely responsible for any and all use of your account.
  5. You may not sell or transfer your profile, password or PIN to another person, organisation or entity.
  6. The Global Gossip Noticeboard and the globalgossip.com site, including My Gossip and all elements of the Global Gossip website, are services provided to community members. If you are a professional organisation you are also welcome to post. However, Global Gossip reserves the right to restrict the number and type of posts by any member whether a person or organisation.
  7. You agree to be solely responsible for any and all content posted on the noticeboard by you, including comments on other posts, links to external sites and content. You acknowledge and accept that Global Gossip is not in any manner responsible for the content you place on the Noticeboard or any other part of the Global Gossip website.
  8. By posting content (including but not limited to photos, movies, files and text) on the Global Gossip website or the noticeboard, you acknowledge that you have the legal right to do so and that you are not breaking any law, including copyright or any other breach of the intellectual property holders’ rights, by doing so.
  9. You acknowledge and accept that all content appearing on the noticeboard or globalgossip.com is protected by copyright and either the property of the Global Gossip Group of companies or the party accredited as the poster of information. You may not reproduce, copy, distribute or publish, store electronically, create derivative works, transmit or in any other way exploit for commercial gain or otherwise any content or posted information on the Noticeboard or any other part of the Global Gossip website.
  10. If you make postings to the noticeboard or globalgossip.com providing false contact details or impersonating another party we reserve the right to pass your details and IP address on to the aggrieved third party, their agents or any law enforcement agency. We also reserve the right to blacklist your IP address and delete any and all of the posts you have made.
  11. You agree, as a condition of using any part of the globalgossip.com site, including but not limited to the noticeboard, that you will not post or transmit any unlawful, threatening, abusive, defamatory, obscene or indecent information or material of any kind, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law or voluntary advertising code.
  12. You agree, as a condition of using any part of the globalgossip.com site, (including but not limited to the noticeboard) that you will not post or transmit any material of any kind which violates or infringes upon the rights of any other person, including material which is an invasion of any privacy or publicity rights or which is protected by copyright, trade mark or any other proprietary right, or with respect to derivative works, without first obtaining permission from the owner or relevant right holder.
  13. You agree, as a condition of using any part of the globalgossip.com website (including but not limited to the noticeboard) that you will not post or transmit any material of any kind which contains a virus or other harmful component.
  14. You agree, as a condition of using any part of the globalgossip.com site (including but not limited to the noticeboard) that you will not download any file posted by any other user if you know, or reasonably ought to know, that the file cannot legally be distributed in such manner.
  15. You understand and accept that Global Gossip may, at its sole discretion and without notification and at any time, remove any post, content, photograph, file, comment or any item whatsoever, made by you on the Global Gossip site, including the noticeboard, whether or not, in its opinion, you have breached any of the conditions contained herein.
  16. Global Gossip also reserves the right, at its own discretion, to block or blacklist the domain of any user violating these terms and conditions from all Global Gossip PCs throughout the Global Gossip network worldwide. Such a decision is the sole right of Global Gossip and by using the Global Gossip services you understand and accept that Global Gossip will not be held responsible for the consequences, financial or otherwise, of such a decision.
  17. You agree that Global Gossip may subject your post to review, comment and ratings. You accept that all such comments and ratings are “fair comment” and reasonable criticism by other users of the Global Gossip site and you agree that Global Gossip may not be held responsible, in any respect, financial or otherwise, for the consequences of the content or nature of any criticism or rating system contained on the Global Gossip website, whether that ratings system has been created by Global Gossip or not.
NOTIFYING AN INFRINGEMENT OF COPYRIGHT

If you believe that your work has been copied in any way that infringes your intellectual property rights, please notify Global Gossip at the following address:

Please ensure that your notice contains an unambiguous description of the offending content and item posted along with your contact details and details that will establish that you are or you are acting on behalf of the bona fide copyright owner and have the legal right to do so. Global Gossip will only remove material at a third party’s request where the legitimate copyright owner’s bona fides has been established to Global Gossip’s satisfaction.

CHARGES FOR POSTINGS

Global Gossip reserves the right to charge for any item or content posted on the Global Gossip website including, but not limited to, the noticeboard, whether by way of direct payment, deduction of credit on a Global Gossip Phone Card or by way of Commission on sale or any other form of payment, at its own discretion. In addition, where a charge is already associated with a post, Global Gossip reserves the right to vary the amount or rate of the charge at its own discretion. Global Gossip will provide not less than 24 hours notice either directly to the person or organisation posting the content or by way of a statement of intent on the Global Gossip website. All fees paid are non-refundable, in all circumstances including, but not limited to, the removal of a post made by you by Global Gossip for any reason whatsoever, or inaccessibility of a post for any reason by the viewing public.

DISCLAIMER OF WARRANTIES

You agree that use of the Global Gossip site and the noticeboard is entirely at your own risk. The Global Gossip site and the noticeboard are provided on an "as is" or "as available" basis, without any warranties of any kind. All express and implied warranties, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary rights are expressly disclaimed to the fullest extent permitted by law. To the fullest extent permitted by law, Global Gossip disclaims any warranties for the security, reliability, timeliness, accuracy, and performance of the Global Gossip site and the noticeboard. To the fullest extent permitted by law, Global Gossip disclaims any warranties for other services or goods received through or advertised on the Global Gossip site or the sites or the noticeboard, or accessed through any links on the Global Gossip site. To the fullest extent permitted by law, Global Gossip disclaims any warranties for viruses or other harmful components in connection with the Global Gossip site or the noticeboard.

Some jurisdictions do not allow the disclaimer of implied warranties. In such jurisdictions, some of the foregoing disclaimers may not apply to you insofar as they relate to implied warranties.

LIMITATION OF LIABILITY

Under no circumstances shall Global Gossip be liable for direct, indirect, incidental, special, consequential or exemplary damages (even if Global Gossip has been advised of the possibility of such damages), resulting from any aspect of your use of the Global Gossip site or the noticeboard, whether the damages arise from use or misuse of the Global Gossip site or the noticeboard, from inability to use the Global Gossip site or the noticeboard, or the interruption, suspension, modification, alteration, or termination of the Global Gossip site or the noticeboard. Such limitation shall also apply with respect to damages incurred by reason of other services or products received through or advertised in connection with the Global Gossip site or the noticeboard or any links on the Global Gossip site, as well as by reason of any information or advice received through or advertised in connection with the Global Gossip site or the noticeboard or any links on the Global Gossip site. These limitations shall apply to the fullest extent permitted by law.

In some jurisdictions, limitations of liability are not permitted. In such jurisdictions, some of the foregoing limitation may not apply to you.
